Terms and Conditions

Definitions

Booking form – means the form for registering the child for FF4L1s sessions.
Carer – means the adult attending the sessions or any part of the sessions with the child.
Coach – means the person employed by FF4L1s to coach the sessions.
Fee – means the price of the term, as applicable at the time of booking.
Football fun 4 little 1s, we or us means Football fun 4 little 1s here after referred to as FF4L1s, the business you have entered into agreement with.
Premises – means the place where the sessions take place.
Pupil – means the child whose details have been entered onto the booking form by you or the carer and who shall be participating in the sessions.
Terms – means the period of 12, 13 or 14 weeks (as applicable).
You or your – means the parent or legal guardian who has entered into this agreement and will be responsible for the payment of the fees.

Responsibility

You confirm and represent that you are the parent or legal guardian with responsibility for the pupil. You confirm that you or a carer will attend each session with the pupil unless expressly agreed in advance with us on a session by session basis and that the pupil shall be deemed to be under the direct care and control of the carer throughout every session and the carer shall be responsible for the welfare and conduct of the pupil throughout the session and whilst on the premises. This paragraph is non inclusive for after school football clubs
You confirm that the information filled out in the booking form (whether or not complete and or signed by the parent) is accurate in all material respects and you will inform FF4L1s of any changes immediately.
On occasions some sessions may be held outdoors in public spaces. During such sessions the carer shall be responsible for the whereabouts of the pupil and shall take special care to ensure that the pupil stays within the boundaries marked out by FF4L1s.
You must inform FF4L1s and our coach of any medical condition or injuries that you, the carer or pupil may have before the start of term or each session, as applicable.
When attending the session, neither the pupil nor carer will be suffering from any illness, infection disease or anything similar.
If you have any health concerns which may have an effect on participation in the sessions, it is advisable that you consult your GP or health visitor before attending sessions.
You shall indemnify and keep indemnified FF4L1s against loss (including loss of profit) liability, costs and expenses which FF4L1s may incur directly or indirectly as a consequence of any action or inaction of a carer or pupil.

Acceptance of terms and conditions

All agreements relating to the provision of the term of sessions by FF4L1s to the pupil are subject to these terms and conditions to the exclusion of all others and that these will be deemed to be acceptable by the parent upon payment of the fees by or on behalf of the parent.
Payment by the carer shall be deemed to have been made on behalf of the parent.
If filling out an online booking form then it will be deemed that the terms and conditions have been accepted once the ‘terms and conditions’ box has been checked and the submit button pressed.
The parent and or carer agree to keep the content of FF4L1s sessions confidential and not to copy or use any part of FF4L1s directly or indirectly unless being used as a homework exercise for the benefit of the FF4L1s pupil.

Fees and payments

You shall pay FF4L1s the fee for a complete term at any time prior to the pupil starting the first session of the term.
Subject to the clause below the term fee is non refundable under any circumstance whatsoever except with the prior written consent of FF4L1s, unless the pupil has attended the first session of their term and given notice that they will not be continuing to attend sessions within 24 hours of attending the first session, in which case the term fee will be refunded minus the cost of the session attended plus an administration fee. Total cost being £10 (preschool) or £5 (toddler).
The deposit paid to reserve your childs place is also the cost of your childs initial session. This amount contains our administration fee. Should you cancel, you will be refunded the amount minus our administration costs which are £5.50 preschool or £2.25 toddler.
Confirmation of booking will only be sent to the email address/mobile number or contact address given in the booking form.
No credit shall be given for sessions missed by the pupil for future classes.
Any sessions missed may be made up by the pupil at an alternative venue on an alternative day at no cost to FF4L1s. You are responsible to inform FF4L1s 24 hours prior to and no later than the evening before your chosen alternative session (if places are available) that you intend for the pupil to be present at a makeup session and at your own expense.
In the event that the pupil has an illness that causes 2 or more sessions to be missed a credit note may be obtained. It is your responsibility to contact FF4L1s office no later than the day of the class to obtain credit. We may request a medical certificate to be produced.
Cheques that are returned by a bank as unpaid will incur an administration fee of £10

Cancellation

FF4L1s may cancel this contract at any time before the pupil commences the term for any reason whatsoever. We shall not be liable for any loss or damage whatsoever arising from such cancellation. In the event of such cancellation we will refund the fees outstanding for that term.
A permanent change in the venue or time of a session will constitute a change of these conditions and will be notified in accordance with the clause below.
We may change these conditions at any time. We will endeavour to give you as much notice as possible in the event of any changes. If you do not agree to these changes, we will refund the fees paid by you for any outstanding sessions.

Discipline

If FF4L1s decides that the pupil and or carers behaviour is unacceptable, FF4L1s are entitled to exclude the pupil and carer from a session or the premises for a period we decide is appropriate, this may be permanent exclusion.
Unacceptable behaviour shall include damage to property, disruptive behaviour, aggression towards the coach or other children but not limited to these and that those shall be reasonably determined by FF4L1s.

Exclusion of liability

FF4L1s accepts responsibility to you, the pupil or the carer for any direct loss suffered by that person (however caused) but not for any indirect or consequential loss or damage however caused, even if we were advised of the possibility of such loss.
You agree that any claim against FF4L1s must be brought within 90 days of the event resulting in such claim.
FF4L1s maximum liability to you and or the pupil and or the carer shall be limited to the total amount of fees paid.
All warranties and conditions whether implied by statute or otherwise are excluded from this contract provided that nothing in this contract shall affect the statutory rights of the parent or pupil.

General

FF4L1s unreservedly retain the right to change the coaching staff where necessary.
It is your responsibility to inform FF4L1s or our coach if you are arriving to your allocated session more than 10 minutes late. In such circumstances where all students are not at their session by 10 minutes past the session start time the coach will be free to leave and the session will be forfeited. In certain circumstances, such as, but not limited to, extreme weather, failure to attend a session by FF4L1s will result in a credit whereas failure to attend a session by yourself will result in forfeiture of the session.
The failure by either party to enforce at any time or for any period any one or more of the obligations arising under these terms and conditions shall not be a waiver of them.
These conditions along with the booking form constitute the entire agreement between you and FF4L1s. No variation to these terms and conditions shall be binding unless agreed in writing by FF4L1s and the parent.
These conditions shall be governed by English law and shall be subject to the jurisdiction of the English courts.
